5 steps you can not skip when you buy housing in Spain

To make the buying process easier, we summarize it in five easy steps.

Buying a home is one of the most important decisions and disbursements that are usually made. It is also common to get lost between paperwork and paperwork. In order to be of help we have summarized the steps that in no case you should skip during the process of buying and selling housing.

1. Review the legal status of the property.

In addition, information on other aspects such as the statutory regime of horizontal property, mortgage clauses, the price paid in previous transmissions or the title of acquisition can also be obtained from the Property Registry.

2. Check out the mortgage charges.

If we find that the floor we want to buy has a mortgage, the next step is to study the terms of this loan. A good way to do this is to ask the seller for a bank certification with the outstanding amount. You can then negotiate with the bank to improve the conditions and the interest rate. Something very important to keep in mind is that you are not obliged to take over the mortgage loan hired by the seller under the same conditions, but you can demand their cancellation or get a new loan in another entity.

3. Sign the sale before a notary.

Going to the notary is basic to closing any contract of sale of housing. Be wary if you are proposed to skip this step. It must be taken into account that the contract of sale may have been previously formalized by both parties in a private document, but will not have all the legal guarantees if it is not filed public deed.

4. Pay the mandatory taxes.

Any home purchase involves the payment of certain taxes. New housing, for example, involves paying the seller VAT (Value Added Tax). If, instead, we buy a used home, we must pay the Tax of Patrimonial Transmissions (ITP) through one of the banking entities identified by the Administration. In both cases, if you buy through a mortgage, the Tax of Documented Legal Acts must be paid into an account of the Public Treasury.

5. Register your property in the Property Registry.

Once the sale was made and the taxes paid, the last step would be to go to the Property Registry to register the house. Although it is not mandatory, if the registration is made, the buyer will be fully protected as owner, since the information in the Register is considered true and could only be modified by a judge.
